Terms & Conditions

These Terms and Conditions outline the agreement between Magic Designs (“we”, “us”, “our”) and you (“the client”, “customer”) for the provision of website design, hosting, and related services.

By requesting a free website or using any services provided by Magic Designs, you agree to the following terms.

1. Service Overview

Magic Designs provides the following services:

  • Free website design and setup

  • Managed hosting

  • Optional business email services

  • Optional SEO, marketing and upgrade services

  • Domain registration and renewal

  • Ongoing support and maintenance

The core website design is provided at no upfront cost. Ongoing services such as hosting, email, upgrades or SEO are charged separately.

2. Free Website Design

2.1
The website build is provided free as part of our service model.
No upfront design fee is charged unless specifically agreed.

2.2
The free design includes a fully functioning website based on the information you provide, including pages such as Home, About, Services and Contact.

2.3
Additional pages, ecommerce functionality, custom development, branding, logos or redesigns may incur optional upgrade fees.

3. Website Ownership and Licence

3.1
Magic Designs retains ownership of the website design, theme files, templates, structure, and code. You are granted a licence to use the website while hosting with us.

3.2
You own:

  • Your business content

  • Your text

  • Your images and media you provided

  • Your domain name (if registered in your name)

3.3
The website cannot be transferred, copied or moved to another provider unless the client pays the buyout fee described in section 10.

4. Hosting

4.1
All free websites must remain hosted on Magic Designs servers unless the buyout fee is paid.

4.2
Hosting includes:

  • Managed server performance

  • Daily backups

  • Security updates

  • SSL certificate

  • Basic support

  • Uptime monitoring

4.3
Hosting is billed monthly or yearly. Failure to pay will result in suspension of hosting services.

5. Domain Names

5.1
You may register a domain through Magic Designs or purchase one independently.

5.2
If Magic Designs manages your domain, you will be billed yearly for renewal.

5.3
Failure to renew may result in loss of the domain.

6. Business Email Services

6.1
Magic Designs offers optional business email accounts.

6.2
Email accounts are billed monthly or yearly per mailbox.

6.3
Magic Designs is not responsible for loss of emails, downtime or data corruption caused by external factors outside our control.

7. Monthly Fees and Payments

7.1
If you accept our free website build, you agree to pay the associated monthly hosting fee.

7.2
Optional services with separate pricing:

  • SEO packages

  • Marketing services

  • Paid upgrades

  • Additional pages

  • Ecommerce setup

  • Email hosting

  • Maintenance tasks outside scope

7.3
All invoices must be paid on time. Late payments may result in temporary suspension of services.

8. Client Responsibilities

You agree to:

  • Provide accurate information for your website content

  • Provide timely feedback and materials

  • Maintain compliance with UK law (no illegal content, counterfeit goods, etc.)

  • Ensure your business activities are lawful

Magic Designs reserves the right to remove websites containing prohibited content.

9. Support

9.1
Basic support includes minor content edits (small text changes, image swaps).

9.2
Major changes, redesigns or new features may incur a fee.

9.3
Support is provided during normal business hours.

10. Website Export or Buyout Fee

If you choose to move your website away from Magic Designs hosting:

10.1
You must pay a Website Export Fee which covers:

  • Providing a transferable version of the website

  • Preparing files

  • Reconfiguring assets

  • Your licence to use the design independently

10.2
Standard Export Fee: £149 to £249 depending on website size and complexity.

10.3
This fee must be paid before any migration or file transfer takes place.

10.4
Without paying the Export Fee, the client does not have the right to copy, move, or reproduce the website.

11. Cancellations

11.1
You may cancel hosting at any time.
Cancellation will result in the website being taken offline.

11.2
If you cancel without paying the Export Fee, the website cannot be transferred.

11.3
Magic Designs is not responsible for loss of traffic, SEO or business resulting from cancellation.

12. Portfolio Usage

You grant Magic Designs permission to:

  • Display your website in our portfolio

  • Use screenshots for marketing

  • Mention your business name as a client

If you do not wish your business to be shown, you must notify us in writing.

13. Liability

Magic Designs is not liable for:

  • Loss of earnings

  • Downtime caused by external providers

  • Data loss

  • Third party service failures

  • Legal or regulatory issues related to your business

  • Incorrect information provided by the client

Our liability is limited to the total amount paid by the client in the previous 12 months.

14. Updates to These Terms

Magic Designs may update these Terms and Conditions at any time.
The latest version will always be available on our website.

15. Governing Law

These terms are governed by the laws of the United Kingdom.
