SERVICE AGREEMENT

This Service Agreement explains how the Magic Designs free website plan operates, including hosting, ownership, usage and upgrade options.

By using our service or submitting your details, you agree to these terms.

1. Definitions

“We”, “Us”, “Magic Designs” refers to Magic Designs, Stockton-on-Tees.
“You”, “Client” refers to the individual or business requesting a website.
“Free Website Plan” refers to our no-upfront-cost website design service.
“Upgrades” refers to optional paid services including SEO, custom domains, advanced features, content support, redesigns and other enhancements.

2. Free Website Plan Overview

The Free Website Plan includes:

A complete custom website designed by Magic Designs
Hosting on Magic Designs servers
Basic content updates (minor text/image edits)
Continued display in our portfolio
No upfront cost

The website is created so you can test your online presence with minimal risk.

3. Ownership and Licensing

3.1 Website Ownership

Websites built on the Free Website Plan remain the property of Magic Designs.

The client receives a license to use the website while it is hosted on Magic Designs’ platform.

3.2 Transferring the Website

If you wish to move the website to external hosting or take full source-code ownership, the following applies:

A Website Export / Buyout Fee will be required
Premium plugins, templates and licensed assets may not be transferrable
Migration is handled by Magic Designs to maintain compatibility

Details and pricing are provided on request.

4. Hosting

Websites under the Free Website Plan are:

Hosted on Magic Designs servers
Managed, updated and maintained by us
Optimised for speed and security

External hosting is not permitted on the free plan.

5. Domains and Email

The Free Website Plan includes hosting, but not:

Domain purchases
Domain renewals
Business email services

If you want a custom domain (example: yourbusiness.co.uk), you may:

Purchase it yourself
Or request Magic Designs to manage it for a yearly fee

If Magic Designs manages the domain, you must keep payments up to date to avoid expiry.

6. Upgrades and Paid Services

Optional upgrades include:

SEO
Google Ads management
Content creation
Custom website redesigns
Advanced features
Additional pages
Priority support
Business email
Domain management
Website export/buyout
Hosting upgrades

All upgrades are optional and clearly priced.

7. Content Responsibility

You are responsible for providing:

Accurate business information
Logos and images you have the right to use
Product/service details for your website

We are not responsible for legal issues arising from content you supply.

8. Prohibited Use

Clients must not:

Host illegal, harmful or offensive content
Copy or replicate Magic Designs’ proprietary templates
Attempt to export, clone or self-host the free website without approval
Use the platform for high-risk or fraudulent activity

Failure to comply may result in suspension.

9. Termination

You may stop using the free website at any time.

Magic Designs may terminate the service if:

Content violates our acceptable use rules
Payments for optional services go unpaid
Hosting misuse or abuse occurs

If the free site is terminated, the website will be taken offline unless an upgrade or export is purchased.

10. Liability Limitations

Magic Designs is not liable for:

Loss of revenue
Loss of data
Third-party service interruptions
Domain issues not managed by Magic Designs
Client misuse or unauthorised changes

Our total liability is limited to the amount paid by you in the previous 30 days.

11. Changes to This Agreement

We may update the Service Agreement at any time. The latest version will always appear on this page.
