Service Agreement

This Service Agreement explains how Magic Designs provides website design, hosting and related services, including setup fees, ownership, usage and optional upgrades.

By using our services or submitting your details, you agree to this agreement.

1. Definitions

“We”, “Us”, “Magic Designs” refers to Magic Designs, Stockton-on-Tees, United Kingdom.
“You”, “Client” refers to the individual or business requesting a website or related services.
“Website Setup” refers to the initial website design and build provided by Magic Designs.
“Upgrades” refers to optional paid services including SEO, domains, advanced features, content support, redesigns and other enhancements.

2. Website Setup Overview

Website setup includes:

A custom website designed by Magic Designs
Initial setup and configuration
Hosting on Magic Designs servers
Basic content updates (minor text or image edits)
Display of the website in our portfolio

A one-off £99 setup fee applies unless otherwise agreed in writing.

Ongoing services such as hosting, SEO, email or upgrades are charged separately.

3. Ownership and Licensing

3.1 Website Ownership

Websites built by Magic Designs remain the property of Magic Designs.

You are granted a licence to use the website while it remains hosted on Magic Designs infrastructure.

3.2 Website Transfer or Buyout

If you wish to move the website to external hosting or take full ownership:

A Website Export or Buyout Fee will apply
Licensed themes, plugins or assets may not be transferable
Migration is handled by Magic Designs to ensure compatibility

Pricing and details are provided on request.

4. Hosting

Websites built by Magic Designs:

Must remain hosted on Magic Designs servers unless a buyout is completed
Are managed, updated and maintained by us
Are optimised for speed, security and stability

External hosting is not permitted without paying the Website Export Fee.

5. Domains and Email

Website setup does not automatically include:

Domain purchases
Domain renewals
Business email services

You may:

Purchase a domain independently
Request Magic Designs to manage your domain for a yearly fee

If Magic Designs manages your domain, payments must remain up to date to avoid expiry.

6. Upgrades and Paid Services

Optional services include, but are not limited to:

SEO services
Google Ads management
Content creation
Custom website redesigns
Advanced features and integrations
Additional pages
Priority support
Business email services
Domain management
Website export or buyout
Hosting upgrades

All upgrades are optional and clearly priced.

7. Content Responsibility

You are responsible for providing:

Accurate business information
Logos, images and media you have the right to use
Product or service details for your website

Magic Designs is not responsible for legal issues arising from content supplied by the client.

8. Prohibited Use

You must not:

Host illegal, harmful or offensive content
Copy, resell or replicate Magic Designs proprietary templates or systems
Attempt to export, clone or self-host the website without approval
Use the platform for fraudulent or high-risk activities

Failure to comply may result in suspension or termination.

9. Termination

You may stop using the service at any time.

Magic Designs may terminate services if:

Content violates acceptable use rules
Payments for hosting or optional services are unpaid
Hosting misuse or abuse occurs

Upon termination, the website will be taken offline unless an export or upgrade has been purchased.

10. Liability Limitations

Magic Designs is not liable for:

Loss of revenue or business
Loss of data
Third-party service interruptions
Domain issues not managed by Magic Designs
Client misuse or unauthorised changes

Total liability is limited to the amount paid by you in the previous 30 days.

11. Changes to This Agreement

This Service Agreement may be updated at any time.
The latest version will always be published on this page.
